The Hills of Rosemont Community Website

Welcome to the official community website of Rosemont Homeowners Association, Inc., also operating as The Hills of Rosemont (the “Association”). These Website Terms and Conditions (the “Terms”) govern your access to and use of the Association’s community website, including any associated pages, resident portal, and features (collectively, the “Website”). Please read these Terms carefully before using the Website.

1. Acceptance of These Terms

By accessing, browsing, registering for, or otherwise using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and by all applicable laws. If you do not agree with these Terms, you should not access or use the Website.

2. Purpose of the Website

The Website is provided solely as a convenience to the owners, residents, and authorized users of The Hills of Rosemont for general community information and communication. Content on the Website is provided for general informational purposes only and does not constitute legal, financial, professional, or other advice. The Website is not monitored continuously and should not be relied upon for emergencies. For any emergency that threatens life or property, contact 911 or the appropriate authorities directly.

3. Relationship to Governing Documents and Applicable Law

The Website does not amend, replace, or supersede the Association’s recorded Declaration of Covenants, Conditions and Restrictions, its Bylaws, its Architectural Guidelines, any Board resolution or rule, or any other governing document. In the event of any conflict between content posted on the Website and the Association’s official governing documents, the official, recorded governing documents control.

Nothing in these Terms waives, limits, or modifies any right, obligation, or notice requirement of the Association or its members under the North Carolina Planned Community Act (Chapter 47F of the North Carolina General Statutes) or other applicable law. Any notice, communication, or record that is required by law or by the governing documents to be delivered in a particular manner is not satisfied solely by posting on the Website, except to the extent electronic delivery is permitted by law and the recipient has consented to it.

4. No Warranties; Information Provided “As Is”

The Website and all content on it are provided on an “as is” and “as available” basis. While the Association strives to keep information accurate and current, the Website may contain errors, omissions, or outdated information. To the fullest extent permitted by North Carolina law, the Association disclaims all warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, timeliness, reliability, merchantability, fitness for a particular purpose, and non-infringement. The Association does not warrant that the Website will be uninterrupted, secure, error-free, or free of viruses or other harmful components. You use the Website, and rely on any content, entirely at your own risk.

5. Limitation of Liability

To the fullest extent permitted by North Carolina law, the Association, its Board of Directors, individual directors, officers, committee members, the community manager, and their respective employees, agents, contractors, and volunteers (collectively, the “Released Parties”) shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss or injury of any kind, arising out of or relating to:

  • your access to, use of, or inability to access or use the Website;
  • any reliance on, or any error, omission, or inaccuracy in, content posted on the Website;
  • any interruption, suspension, delay, downtime, or failure of the Website;
  • any unauthorized access to or alteration of data, or any virus or other harmful component; or
  • any act, omission, content, or conduct of any third party or other user of the Website.

This limitation applies regardless of the legal theory on which a claim is based and even if a Released Party has been advised of the possibility of such damages.

6. Release and Assumption of Risk

By using the Website, you assume all risks associated with that use. To the fullest extent permitted by North Carolina law, you release, waive, and agree to hold harmless the Released Parties from and against any and all claims, demands, causes of action, and liabilities arising out of or relating to your use of the Website. The Website, and any related community technology referenced on it, are supplemental conveniences only and do not create any duty or obligation on the part of the Association or the Released Parties to any person.

7. Member and User Conduct

You agree to use the Website lawfully, respectfully, and in a manner consistent with the Association’s governing documents. You agree that you will not:

  • post or transmit any content that is unlawful, defamatory, harassing, threatening, obscene, fraudulent, or invasive of another’s privacy;
  • post false, misleading, or impersonating information;
  • use the Website for commercial solicitation or advertising, except where expressly permitted (such as the Community Classifieds, subject to its stated rules);
  • infringe any copyright, trademark, or other intellectual property right; or
  • attempt to gain unauthorized access to, scrape, disrupt, overload, or interfere with the Website or its security features.

8. User-Submitted Content and Views Expressed by Users

The Website may allow owners and residents to post content, including in a community forum, message board, classifieds, comments, or similar features. You are solely responsible for any content you submit, and you represent that you have the right to submit it.

Any opinions, statements, views, or information expressed in posts, comments, or other content submitted by users — including on the community forum, message board, classifieds, or any comment feature — are solely those of the individual community member who posted them. Such content does not represent, and shall not be attributed to, the views, positions, or official statements of the Association, its Board of Directors, any individual director, officer, committee member, the community manager, or any other Released Party. The Association does not endorse, adopt, verify, or assume responsibility for any opinion or statement expressed in user-submitted content, and the appearance of such content on the Website shall not be construed as approval or ratification by the Association or the Board of Directors.

The Association does not pre-screen or verify user content. The Association and the community manager reserve the right, but assume no obligation, to monitor, review, edit, refuse, or remove any user-submitted content, in whole or in part, at any time and without notice, including content deemed inappropriate, offensive, or in violation of these Terms. By submitting content, you grant the Association a non-exclusive, royalty-free license to display, store, and distribute that content on the Website in connection with operating the community site.

9. Community Classifieds and Resident-to-Resident Transactions

Any classifieds, marketplace, recommendations, or similar features are provided strictly as a convenience. The Association does not endorse, guarantee, vet, or take part in any listing, offer, sale, exchange, service, or transaction between users. All such dealings are made solely between the participating parties, who are responsible for their own arrangements and assume all associated risk. To the fullest extent permitted by law, the Released Parties shall not be liable for any loss, damage, or dispute arising from any such listing or transaction.

10. Account Registration and Security

Certain areas of the Website are restricted and require registration. You agree to provide accurate registration information, to keep your contact information current, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account, and you agree to notify the Association or the community manager promptly of any unauthorized use. The Association is not responsible for any loss arising from your failure to safeguard your credentials.

11. Third-Party Links, Services, and Platforms

The Website is hosted and operated through one or more third-party platforms and may incorporate third-party features and links, which may include, for example, hosting providers, payment processors, mapping, weather, translation, and access or camera systems. The Association does not control and is not responsible for the content, products, services, availability, security, or privacy practices of any third party. Your use of any third-party service is at your own risk and subject to that provider’s own terms and policies.

12. Privacy

Information collected through the Website is used for legitimate community and Association purposes. The Association takes reasonable measures to protect such information but cannot guarantee its absolute security. You agree not to post or share the personal information of any other person without that person’s consent. Your use of the Website may also be subject to the privacy practices of the third-party platform that hosts it.

13. Intellectual Property

The Website and its content — including text, graphics, logos, the community name and marks, and posted documents — are the property of the Association or its licensors and are protected by applicable law. Owners and residents are granted a limited, revocable, non-exclusive license to access and use the Website for personal, non-commercial community purposes only. No content may be copied, reproduced, distributed, or used for any other purpose without the Association’s prior written permission.

14. Indemnification

To the fullest extent permitted by North Carolina law, you agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to your use of the Website, any content you submit, or your violation of these Terms or of any applicable law or right of a third party.

15. Suspension and Termination of Access

The Association or the community manager may, at its discretion, suspend, restrict, or terminate any user’s access to the Website, in whole or in part, with or without notice, for violation of these Terms or for any other reason. Access to certain restricted pages is limited to registered owners and residents in good standing.

16. Changes to These Terms

The Association, through its Board of Directors, may revise or update these Terms at any time. Revised Terms are effective when posted on the Website. Your continued use of the Website after any change constitutes your acceptance of the revised Terms. You are encouraged to review these Terms periodically.

17. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Website shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in or serving Chatham County, North Carolina.

18. Severability and No Waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Nothing in these Terms is intended to limit any liability that cannot be limited or excluded under North Carolina law, including liability for gross negligence or willful misconduct. The Association’s failure to enforce any provision shall not be deemed a waiver of that provision or of any other provision.

19. Entire Agreement

These Terms, together with the Association’s governing documents as they relate to community matters, constitute the entire agreement between you and the Association regarding your use of the Website and supersede any prior understandings on that subject.
